1. About the Service

TOEFL Practice is an online English-learning platform designed to help learners prepare for the TOEFL iBT exam. It provides practice questions across Reading, Listening, Speaking, and Writing, along with teacher feedback.

2. Accounts

1. You must be at least 14 years old to use this service. Users under 14 require verifiable parental or legal guardian consent.
2. Registration is completed through Google account sign-in.
3. After registration, your account must be approved by the teacher (operator) before you can use the service.
4. You are responsible for keeping your account information accurate. You may not share or transfer your account to others.
5. To delete your account, contact the operator and all associated data will be removed.

3. Rules of Use

Users must not:

• Copy, distribute, or share any content from the service, including questions, passages, and audio materials, without permission.
• Interfere with the normal operation of the service.
• Use another person's account or violate anyone's personal information.
• Use the service for commercial purposes other than personal learning.

4. Intellectual Property

1. All practice questions, scenarios, discussion topics, grammar explanations, and other content belong to the operator.
2. Essays and emails you write through the service remain your own work.
3. The operator may use anonymized versions of user-written content for service improvement and learning analytics.

5. Disclaimers

1. This service is not affiliated with ETS (Educational Testing Service) and is not an official ETS product. TOEFL® is a registered trademark of ETS.
2. Using this service does not guarantee any specific TOEFL score.
3. AI scoring and feedback are provided for reference only and may differ from actual TOEFL scoring standards.
4. The operator is not liable for technical errors or data loss unless caused by willful misconduct or gross negligence.

6. Service Changes & Interruptions

1. The operator may change the service's content, features, or design without prior notice.
2. The service may be temporarily unavailable for maintenance or technical issues.
3. The operator may discontinue the entire service for operational reasons, with advance notice to users.

7. Account Restrictions

The operator may restrict or delete a user's account without prior notice if the user violates these terms or disrupts normal service operation.

8. Changes to These Terms

1. The operator may update these terms as needed. Changes will be announced through the service.
2. Users who do not agree with updated terms may stop using the service and request account deletion.

9. Governing Law & Disputes

1. These terms are governed by the laws of the Republic of Korea.
2. Any disputes arising from the use of this service shall be submitted to the competent court in Seoul, Republic of Korea.

10. Paid Services, Subscriptions & Refunds

1. Paid Subscriptions: Users may purchase recurring subscription plans. Subscriptions automatically renew on each monthly billing cycle using the registered payment method unless cancelled.
2. Statutory Cooling-Off & Full Refund: In accordance with the Act on Consumer Protection in Electronic Commerce, users may request a full refund within 7 days of payment if no paid content (mock tests, assignments, AI scoring/feedback) has been accessed.
3. Cancellation & Mid-Term Termination: Users may cancel auto-renewal at any time via the subscription management page. Access continues through the end of the current billing cycle. Mid-term refund requests are subject to statutory deduction rules based on days elapsed and processing fees.
4. Refund Inquiries: Refund requests can be made via email (info@tempoenglish.kr) or phone (02-6013-4000) and are processed within 3 business days.

제1조 (서비스 소개)

본 서비스("TOEFL Practice")는 TOEFL iBT 시험을 준비하는 학습자를 위한 온라인 영어 학습 플랫폼입니다. 읽기, 듣기, 말하기, 쓰기 영역의 연습 문제와 선생님 피드백 기능을 제공합니다.

제2조 (회원가입 및 계정)

1. 본 서비스는 만 14세 이상부터 이용할 수 있습니다. 만 14세 미만의 이용자는 법정대리인(부모 등)의 동의가 필요합니다.
2. 회원가입은 Google 계정을 통한 소셜 로그인으로 이루어집니다.
3. 가입 후 선생님(운영자)의 승인을 받아야 서비스를 이용할 수 있습니다.
4. 회원은 자신의 계정 정보를 정확하게 유지할 책임이 있으며, 타인에게 계정을 공유하거나 양도할 수 없습니다.
5. 회원 탈퇴를 원할 경우 운영자에게 요청하면 계정 및 관련 데이터를 삭제합니다.

제3조 (서비스 이용 규칙)

회원은 다음 행위를 해서는 안 됩니다.

• 서비스에 포함된 문제, 지문, 음성 등의 콘텐츠를 무단으로 복제, 배포, 공유하는 행위
• 서비스의 정상적인 운영을 방해하는 행위
• 타인의 계정을 도용하거나 개인정보를 침해하는 행위
• 서비스를 학습 이외의 상업적 목적으로 이용하는 행위

제4조 (지식재산권)

1. 본 서비스에 포함된 모든 연습 문제, 시나리오, 토론 주제, 문법 해설 등의 콘텐츠에 대한 저작권은 운영자에게 있습니다.
2. 회원이 서비스를 통해 작성한 글(에세이, 이메일 등)의 저작권은 해당 회원에게 있습니다.
3. 운영자는 서비스 개선 및 학습 분석 목적으로 회원의 작성 글을 익명화하여 활용할 수 있습니다.

제5조 (면책 조항)

1. 본 서비스는 ETS(Educational Testing Service)와 무관하며, ETS의 공식 서비스가 아닙니다. TOEFL®은 ETS의 등록 상표입니다.
2. 본 서비스의 이용이 특정 TOEFL 점수를 보장하지 않습니다.
3. 서비스 내 AI 채점 및 피드백은 참고용이며, 실제 TOEFL 채점 기준과 다를 수 있습니다.
4. 운영자는 서비스 이용 중 발생하는 기술적 오류나 데이터 손실에 대해 고의 또는 중대한 과실이 없는 한 책임을 지지 않습니다.

제6조 (서비스 변경 및 중단)

1. 운영자는 서비스의 내용, 기능, 디자인을 사전 고지 없이 변경할 수 있습니다.
2. 시스템 점검, 장애 복구 등의 사유로 서비스가 일시적으로 중단될 수 있습니다.
3. 운영자는 운영상의 사유로 서비스 전부를 중단할 수 있으며, 이 경우 회원에게 사전 고지합니다.

제7조 (이용 제한)

운영자는 회원이 본 약관을 위반하거나 서비스의 정상적인 운영을 방해한 경우, 사전 통보 없이 해당 회원의 서비스 이용을 제한하거나 계정을 삭제할 수 있습니다.

제8조 (약관 변경)

1. 운영자는 필요 시 본 약관을 변경할 수 있으며, 변경된 약관은 서비스 내 공지를 통해 고지합니다.
2. 변경된 약관에 동의하지 않는 회원은 서비스 이용을 중단하고 탈퇴할 수 있습니다.

제9조 (준거법 및 분쟁 해결)

1. 본 약관은 대한민국 법률에 따라 해석됩니다.
2. 본 서비스 이용과 관련하여 발생하는 분쟁은 서울 소재 관할 법원에 제기합니다.

제10조 (유료 서비스, 정기결제 및 환불 규정)

1. 유료 서비스 및 정기결제: 회원은 회사가 제공하는 유료 구독 플랜(정기결제)을 이용할 수 있으며, 정기결제는 매월 지정된 결제일에 사전 등록된 결제수단(신용카드 등)을 통해 자동으로 결제 및 갱신됩니다.
2. 청약철회 및 전액 환불: 회원은 유료 결제일로부터 7일 이내에 서비스 내 유료 콘텐츠(모의고사, 과제 풀이, AI 첨삭 등)를 일체 이용하지 않은 경우, 결제 금액 전액을 환불받을 수 있습니다(전자상거래 등에서의 소비자보호에 관한 법률 제17조).
3. 이용 후 해지 및 환불:
   • 회원은 언제든지 서비스 내 [구독 관리]를 통해 다음 회차 정기결제 해지를 예약할 수 있습니다. 해지 시 이미 결제된 해당 이용 기간(만료일)까지는 정상적으로 서비스를 이용할 수 있으며, 다음 결제일부터는 요금이 청구되지 않습니다.
   • 중도 해지 및 즉시 환불을 요청하는 경우, 관계 법령 및 소비자분쟁해결기준에 따라 결제 금액에서 이미 경과한 이용 일수에 해당하는 금액 및 결제대행 수수료를 공제한 후 잔여 금액을 환불합니다.
4. 환불 신청 방법: 회원은 고객센터 이메일(info@tempoenglish.kr) 또는 유선전화(02-6013-4000)를 통해 환불을 신청할 수 있으며, 회사는 접수일로부터 영업일 기준 3일 이내에 환불 절차를 진행합니다.
